Online store terms and conditions

§ 1. General provisions

The AGAPOL store at agapolh.com is operated by AGAPOL SPÓŁKA Z OGRANICZONĄ ODPOWIEDZIALNOŚCIĄ, registered office: Zakładowa 1, 70-790 Szczecin, Polska, National Court Register (KRS): 0000744722, Polish tax ID (NIP): 8522648980, REGON: 381006846. These terms govern electronic services and sales of physical paper products to consumers and businesses. Wholesale conditions may be agreed separately without restricting statutory consumer rights. The terms can be saved or printed free of charge; contractual documents are provided on a durable medium as required by law.

§ 2. Definitions

• Seller: the operator named in § 1. Customer: a person or organisation purchasing products.
• Consumer: an individual entering into a contract outside their business or professional activity.
• Business with consumer rights: a sole trader whose purchase relates to their business but is not professional in nature under applicable Polish law.
• Product: a physical item offered by the store. Cart: the function for choosing items and quantities. Order: a customer’s declaration intended to conclude a sales contract.

§ 3. Electronic services

The catalogue, cart, order form and contact form are free. They require internet access, a current browser supporting JavaScript and local storage, and an email address for orders or enquiries. No account is required. Free services end when you stop using them; this does not cancel a sales contract. Unlawful content and interference with the store are prohibited.

Report technical issues to [email protected] with a description and contact details. Consumer complaints are answered within 14 days. Technical interruptions do not limit rights under existing contracts.

§ 4. Orders and contracts

Orders can be placed at any time. Choose products and quantities, select delivery and enter required details. You may correct the cart and read these terms and the privacy policy before payment.

Continuing to Stripe starts payment. The final confirmation on the payment page places the order with an obligation to pay; the total is shown before confirmation. The sales contract is concluded after successful payment and acceptance by the store system. Payment confirmation and order details are made available electronically.

If a paid order cannot be fulfilled, we will contact the customer to agree the next steps and refund amounts due. We do not substitute products without consent.

§ 5. Prices and payment

Prices are in Polish zloty (PLN) and include applicable taxes. Delivery charges are separate; the full total is shown before a binding order. Stripe handles payment using the methods displayed on its payment page. An incomplete payment does not confirm a paid order.

Price changes do not affect concluded contracts. Announced reductions include legally required previous-price information. Sales documents are issued under applicable law; enter invoice details when ordering. Any additional payment-method charges require prior information.

§ 6. Delivery

Delivery is within Poland, by InPost Parcel Locker for eligible products or by courier. Available methods and costs are shown at checkout. Larger wholesale deliveries are agreed before the contract. Delivery timing is agreed before ordering; absent a different agreement, products are delivered promptly and within 30 days of the contract. Fulfilment begins after payment confirmation; we inform customers of delays.

The seller bears shipment risk until the consumer or their nominated recipient receives the products, subject to statutory exceptions. Document any damage and contact us. A carrier damage report is not a condition for making a complaint.

§ 7. Withdrawal and returns

Consumers and qualifying sole traders may withdraw from a distance contract without giving a reason within 14 days of receiving products. For separate deliveries, the period starts on receipt of the last item, batch or part.

Send your declaration before the deadline to [email protected] or Zakładowa 1, 70-790 Szczecin, Polska. The template below is optional. Return products to the same address within 14 days of withdrawal; the customer pays direct return costs.

We refund payments, including the cheapest standard delivery offered, within 14 days of receiving the declaration. We may wait until products or proof of return arrive, whichever is earlier. Refunds use the original payment method unless another free method is agreed.

Customers are liable for diminished value from handling beyond what is needed to inspect the products. Statutory exclusions include custom-made items and sealed products unsuitable for return on health or hygiene grounds once unsealed. Selling paper products alone does not remove withdrawal rights.

§ 8. Product complaints

Statutory liability for non-conformity applies to consumers and qualifying sole traders, generally for two years from delivery. Remedies include repair or replacement and, in statutory circumstances, price reduction or withdrawal.

We answer consumer complaints within 14 days. Statutory repair or replacement is free, within a reasonable time and without significant inconvenience. The seller bears necessary remedy costs. Any warranty is additional to statutory rights.

§ 9. Dispute resolution

Consumers may contact a local consumer ombudsman or the Polish Trade Inspection for help and voluntary alternative dispute resolution. Information is available at polubowne.uokik.gov.pl. These procedures do not limit access to the courts.

§ 10. Privacy and final provisions

The privacy policy explains data processing and browser storage. Acceptance of these terms is not marketing consent. Polish law applies without depriving consumers of mandatory protections. Courts have jurisdiction under general rules. Updates apply to future orders and do not affect rights under existing contracts.
